Colourful Connections is a self-development coaching programme that uses creative arts as a reflective and growth-oriented tool. It is categorically not a psychological, psychiatric, or clinical mental-health service. Facilitation is not provided by registered psychologists, clinical psychologists, psychiatrists, or therapists as defined under the Kenya Psychology Act No. 7 of 2011 (Cap 251E), the Medical Practitioners and Dentists Act (Cap 253), or the Mental Health (Amendment) Act 2022.
Participation in our programme is not a substitute for professional mental-health care, diagnosis, or treatment. If you are experiencing a mental-health crisis, suicidal thoughts, or symptoms of a clinical condition, please contact a licensed professional immediately or call the Befrienders Kenya helpline: 0722 178 177.
1. Acceptance of Terms
By accessing our website, completing our self-assessment, or enrolling in any Colourful Connections programme, you confirm that you:
- have read and understood these Terms in full;
- are at least 18 years of age;
- agree to be bound by these Terms and our Privacy Policy; and
- are participating voluntarily and of your own free will in a self-development context, not as a patient or clinical service user.
If you do not agree with any part of these Terms, please do not use our services. These Terms constitute a legally binding agreement governed by the laws of Kenya.
2. Eligibility
Our programmes are open to adults aged 18 and over. By enrolling, you represent that you are of legal age to enter into binding contracts under the Laws of Kenya (including the Law of Contract Act, Cap 23).
We reserve the right to decline enrolment at our sole discretion if we believe participation would not be appropriate for a person's current circumstances. In such cases, we will refund any fees paid in full.
3. Nature of the Programme
Colourful Connections offers structured group and individual coaching journeys using expressive arts (painting, creative reflection, and guided conversation) to support:
- emotional self-awareness and resilience;
- intentional personal growth and direction;
- community connection and supported self-expression;
- general wellness practices and mindful living.
We explicitly do not:
- provide diagnosis of any mental-health condition;
- prescribe or advise on medication;
- provide psychotherapy, counselling, or clinical intervention;
- hold ourselves out as registered under the Kenya Psychology Act 2011 or any equivalent professional body.
Programme outcomes vary by individual. We make no guarantees of specific results and outcomes are not equivalent to those of clinical treatment.
4. Programme Structure and Delivery
We currently offer three programme tiers:
- Starter Journey — 3-week introductory programme;
- Growth Journey — 6-week intermediate programme;
- Transformational Journey — 10-week comprehensive programme.
Programme details, session schedules, and delivery formats (in-person, online, or hybrid) are communicated at the time of enrolment and are subject to reasonable change. We will give at least 7 days' notice of any material change to schedule or format.
5. Payment and Pricing
All programme fees are quoted in Kenyan Shillings (KES) and are inclusive of VAT where applicable. Payment in foreign currency is accepted at the prevailing exchange rate and is subject to any applicable bank fees.
- Full payment is due at the time of enrolment unless a payment plan has been agreed in writing.
- Access to programme materials begins once payment is confirmed.
- We accept payment via M-Pesa, bank transfer, and other methods indicated at checkout.
- We do not store your payment card or banking details on our servers.
6. Refund and Cancellation
Please read our full Refund Policy before enrolling. In summary:
- Cancellation within 48 hours of enrolment (provided the programme has not yet commenced): full refund;
- Cancellation before the first session: 75% refund;
- Cancellation after the first session: no refund, though we may offer a credit towards a future programme at our discretion;
- Programme cancellation by us: full refund within 14 days, no additional liability.
Refund rights under the Kenya Consumer Protection Act 2012 are not affected by this Policy.
7. Participant Conduct
We are committed to creating and maintaining a safe, respectful, and inclusive space. By participating, you agree to:
- treat facilitators, staff, and fellow participants with dignity and respect;
- maintain confidentiality — what is shared in the group stays in the group;
- not record, photograph, or share content from sessions without explicit consent;
- not engage in harassment, discrimination, or any conduct that threatens the physical or emotional safety of others;
- disclose to the facilitator before a session if you are in acute distress or crisis.
We reserve the right to remove any participant who violates these standards, without refund, where the safety or wellbeing of the group is at risk.
8. Mental Health and Safeguarding Protocol
While our programme is not a clinical service, we take your wellbeing seriously. Our facilitators are trained to recognise signs of distress and will:
- pause or adjust a session where a participant appears to be in significant distress;
- provide signposting to appropriate professional support, including the Befrienders Kenya helpline (0722 178 177) and the Kenya Red Cross psychosocial support line (1199);
- contact emergency services in circumstances where there is an immediate risk to life, overriding confidentiality only to the extent required by law or to prevent serious harm.
By enrolling, you acknowledge these protocols and agree that such actions, taken in good faith, do not constitute a breach of your confidentiality.
9. Photography, Artwork, and Image Rights
Photographs and images may be taken during in-person workshop sessions.
- Opt-in consent: we will request your explicit, written or verbal consent before photographing you or displaying your artwork on our website, social media, or marketing materials. Consent is voluntary and does not affect your right to participate.
- Withdrawal of consent: you may withdraw consent at any time by submitting an Image Takedown Request. We will remove the relevant content within 14 business days.
- Ownership of artwork: all artwork you create during sessions remains your intellectual property under the Kenya Copyright Act No. 12 of 2001. Displaying your artwork with your consent does not transfer ownership to us.
- Programme materials: all course content, frameworks, and resources created by Colourful Connections remain our intellectual property. You may use them for personal, non-commercial purposes only.
10. Intellectual Property
All content on this Site — including text, design, graphics, programme frameworks, and the Colourful Connections name and logo — is protected under the Kenya Copyright Act 2001 and applicable intellectual property law. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
11. Limitation of Liability
To the maximum extent permitted by the laws of Kenya (including the Consumer Protection Act 2012):
- We are not liable for any indirect, incidental, or consequential loss arising from your participation in our programmes;
- Our total liability for any claim arising out of or related to these Terms shall not exceed the amount you paid for the specific programme that is the subject of the claim;
- We are not liable for outcomes related to pre-existing medical or mental-health conditions that were not disclosed to us;
- Nothing in these Terms limits our liability for death, personal injury caused by our negligence, or fraudulent misrepresentation.
12. Confidentiality and Group Norms
In group settings, participants may share personal or sensitive information. All participants agree to hold such disclosures in strict confidence and not to share, repeat, or publish anything another participant shares in a session without their express consent. Breach of this obligation may result in removal from the programme.
13. Data Protection
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms and is governed by the Kenya Data Protection Act 2019. By accepting these Terms, you acknowledge you have read and understood our Privacy Policy.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya, subject to the dispute resolution process below.
15. Dispute Resolution
We encourage amicable resolution of any dispute. Before commencing formal proceedings:
- Direct negotiation (14 days): Contact us at nyawira.kuria@colourfulconnection.com setting out the nature of your dispute. We will respond within 10 working days.
- Mediation (30 days): If direct negotiation fails, either party may propose mediation under the Nairobi Centre for International Arbitration (NCIA) mediation rules.
- Litigation: If mediation fails or is refused, either party may pursue their rights in the competent courts of Kenya.
16. Changes to These Terms
We reserve the right to update these Terms. Material changes will be communicated to enrolled participants by email at least 14 days before taking effect. Continued participation after the effective date constitutes acceptance of the revised Terms. The current version will always be available at this URL.
